North Dakota distinguishes gambling conduct and operating a gambling business. Under section 12.1-28-02(1), the private-premises conduct described there is an infraction when more than $25 is wagered per individual player per hand, game or event. This is an individual wager threshold, not a limit on the whole pot.
The section includes other offenses, including a higher individual wager threshold and conducting a gambling business. Staying below one threshold does not establish that every aspect of a game complies.
