To assess a home poker game in Virginia, start with Virginia Code section 18.2-334. Review sections 18.2-325 and 18.2-334. Section 18.2-334 addresses private residences, their common use for games and a separate restriction on operating gambling. Read it with the definitions.

Before hosting or joining, confirm:

  • Is the residence commonly used for these games, and could a participant be operating gambling?
  • Do the rules cover this private residence, club, business or public event?
  • How do rake, seat fees, required purchases, donations or other organizer benefits affect the game?
  • What limits or conditions apply to wagers, player winnings, entry fees and prizes?
  • What age and other participation requirements apply?

Use the official source to identify the applicable conditions and effective amendments. A private venue or game without rake is only part of the assessment.
