To assess a home poker game in Illinois, start with Illinois Compiled Statutes, gambling. Review 720 ILCS 5/28-1 and its listed exceptions. Read the offense and its exceptions. Permission for one licensed or exempt activity does not establish that another game qualifies.
Before hosting or joining, confirm:
- Does this poker game fit an actual statutory exception and all of its conditions?
- Do the rules cover this private residence, club, business or public event?
- How do rake, seat fees, required purchases, donations or other organizer benefits affect the game?
- What limits or conditions apply to wagers, player winnings, entry fees and prizes?
- What age and other participation requirements apply?
Use the official source to identify the applicable conditions and effective amendments. A private venue or game without rake is only part of the assessment.
