Florida's penny-ante provision includes poker, subject to specific conditions. The $10 limit is each player's winnings in one round, hand or game. It is not a $10 limit on the whole pot.
The location must meet the statute's definition of a dwelling. The host may receive no commission or other consideration for allowing the game; admission or participation fees are prohibited; advertising the game is restricted; and players must be at least 18. Read the full provision for the permitted locations and all conditions.
See Florida Statutes section 849.085 before relying on this exception. Different arrangements need a separate review.
