Delaware has criminal provisions concerning gambling activity and premises. Section 1404 covers certain conduct involving premises used for a gambling offense, while section 1406 addresses gaming tables and devices.
Whether a proposed poker game falls within those provisions depends on the actual activity. Check the venue, game and equipment, money or other value wagered, host's role and benefits, and participants' ages.
Read Delaware Code, Title 11, Chapter 5, Subchapter VII, Part D and obtain local advice about the proposed game.
General information only. Check the current law and obtain local advice about your particular arrangements.
