To assess a home poker game in California, start with California Penal Code section 337j. Review section 337j and other applicable gambling provisions. Section 337j excludes certain private-home card games from its controlled-game definition when nobody receives money for operating the game beyond personal player winnings. That definition does not settle every gambling or local-law question.
Before hosting or joining, confirm:
- Is it a private-home game, and does anyone receive operating money beyond their own player winnings?
- Do the rules cover this private residence, club, business or public event?
- How do rake, seat fees, required purchases, donations or other organizer benefits affect the game?
- What limits or conditions apply to wagers, player winnings, entry fees and prizes?
- What age and other participation requirements apply?
Use the official source to identify the applicable conditions and effective amendments. A private venue or game without rake is only part of the assessment.
